How does the Social Security disability appeals process work?

If your initial application for Social Security disability benefits is denied, you have sixty (60) days from the date of the denial letter to file an appeal or a request for reconsideration.  If your request for reconsideration is denied, you will again have sixty (60) days to appeal that decision and request a hearing in front of an Administrative Law Judge.  You will then have the opportunity to present your evidence during the trial.  If appeals are not made within these time frames, your Social Security disability case must start over with the initial application process.

If I am off work and seeking Social Security disability benefits, how do I pay an attorney?

The SSDI and SSI lawyer fees associated with your disability claim are paid on a contingency basis to Bergman & Yiangou.  If a favorable decision is reached, we will be awarded 25% of your lump-sum award, not to exceed $6,000.00.  This fee is automatically withheld by the Social Security Administration when your benefits are awarded.  Simply put – we only get paid when you are awarded benefits.
